USER AGREEMENT

1. General Provisions

1.1. This Agreement has been developed in accordance with the Law of the Republic of Kazakhstan dated May 21, 2013, "On Personal Data and Their Protection" and other legislative acts of the Republic of Kazakhstan.

1.2. By submitting their data, the User agrees to the legally binding execution of the terms and conditions set forth below, which shall take effect immediately.

1.3. This User Agreement (hereinafter referred to as the "Agreement") constitutes a public offer. By submitting an application, the User is deemed to have acceded to this Agreement.

1.4. This Agreement may be amended by the Website Administration. The new version of the Agreement shall enter into force from the moment it is posted on the Website ; the current version is always available on the Website.

2. Terms Used in This Agreement

2.1. Personal Data – information relating to a User who is identified or identifiable on the basis of such information, recorded on electronic, paper, and/or other material media.

2.2. Collection and Processing of Personal Data – actions performed by the School aimed at the accumulation, storage, modification, supplementation, use, distribution, depersonalization, blocking, and destruction of personal data.

2.3. Use of Personal Data – actions performed by the School with the User's personal data aimed at achieving the purposes of the School's activities.

2.4. Distribution of Personal Data – actions performed by the School as a result of which the User's personal data becomes accessible to third parties.

2.5. User – an individual who gives consent to the collection and processing of their personal data.

3. Terms of Use for Materials Posted on the Website

3.1. Copying, reprinting, and subsequent distribution of the Website materials is permitted only with the written consent of the School or with the mandatory inclusion of an active hyperlink to the source.

3.2. The use of photo and video materials from the Website, including copying, distribution, or publication, must be accompanied by the School's logo and a link to the Website as the primary source of information (it is prohibited to crop or erase the logo on the photo and video materials of the Website).

3.3. The distribution of a news report or other information posted on the Website is permitted only after it has been rewritten in a different wording (rewrite). In doing so, a hyperlink to the original material and the phrase "as reported by the KERN website" are mandatory and must be placed in the first paragraph of the distributed material.

3.4. In the event of obtaining written permission from the School to use infographics, photo, video, and audio materials posted on the Website, any editing of these materials is prohibited. In the event of any claims, please contact the administrators or moderators of the Website.

4. Collection and Processing of Personal Data

4.1. The collection and processing of Users' Personal Data is carried out by the School for the purposes of executing the User Agreement, providing services rendered by the School to the User, including sending notifications and information regarding the School's activities, processing requests from the User, offering new services of the School, including offering personalized services to the User, enabling User participation in projects and contests, as well as the exercise of rights and duties by the School in accordance with applicable legislation. Additional purposes for the collection and processing of Personal Data may be declared within the scope of using specific Services.

4.2. When using the Website, the School may collect and process data provided by the User, including surname, first name, mobile phone number, and email address, as well as technical data transmitted automatically during visits to the Website: IP address, date and time of visits, cookies, browser, and operating system information. The School collects only the data necessary to achieve the collection and processing purposes specified in clause 4.1 of this Agreement.

4.3. Personal Data may be supplemented and updated by the User themselves.

4.4. The storage of Personal Data is carried out by the School within the territory of the Republic of Kazakhstan for the period necessary to achieve the purpose of its collection and processing under the User Agreement, and for three years after the termination of the said User Agreement, unless a shorter period is established by any applicable legislation.

5. Protection of Personal Data

5.1. Users' Personal Data constitutes confidential information and is protected by the legislation of the Republic of Kazakhstan.

5.2. The School possesses modern technologies and internal procedures and performs all actions aimed at protecting Personal Data from external interference, unauthorized attempts to access, modify, disclose, or destroy the information.

5.3. The primary database of Users' Personal Data is stored on servers located within the territory of the Republic of Kazakhstan. In the case of using services whose servers are located outside the Republic of Kazakhstan, cross-border data transfer shall be carried out in accordance with the legislation of the Republic of Kazakhstan.

5.4. Access to Users' Personal Data is granted exclusively to the Website Administration for the performance of their official duties.

5.5. All employees of the School and other persons working with Personal Data sign a non-disclosure agreement regarding confidential information and are warned of potential disciplinary, administrative, civil, and criminal liability in the event of violating the norms and requirements of the effective legislation of the Republic of Kazakhstan in the field of personal data processing.

6. Provision of Personal Data to Third Parties

6.1. The transfer of Personal Data to third parties is carried out in the manner and in cases provided for by the legislation of the Republic of Kazakhstan.

6.2. For the purpose of executing the User Agreement and fulfilling the primary objective of the School's activities, the User agrees and permits the School to carry out the processing of the User's Personal Data, including the results of automated processing of such data, in compliance with applicable legislation.

6.3. In the event that Personal Data is provided to third parties, the School shall take all permissible measures to protect it from unauthorized use and undertakes to use it in accordance with the provisions of this Agreement and the legislation of the Republic of Kazakhstan. The School ensures the Users' right to privacy, and accordingly, no third parties shall receive information regarding Users' correspondence.

6.4. The User acknowledges that data transmission over the Internet involves the risk of unauthorized access by third parties. The School takes all reasonable measures provided for by legislation to protect Personal Data; however, it cannot guarantee absolute data security during transmission over the Internet. The School's liability shall be determined in accordance with the legislation of the Republic of Kazakhstan.

7. Final Provisions

7.1. The Agreement and the relations between the User and the School shall be governed by and construed in accordance with the Law of the Republic of Kazakhstan dated May 21, 2013, "On Personal Data and Their Protection". Matters not regulated by the Agreement shall be resolved in accordance with the legislation of the Republic of Kazakhstan.

7.2. The School has the right to amend and/or supplement the Agreement. The effective version of the Agreement is posted on the Website, and the User is recommended to review it periodically.

7.3.
